1. Quotations
The validity period of the quotation is 30 days after the quotation date. Our quotes are always target prices and not binding. These are always drawn up without mentioning the legal taxes and charges, which are always borne by the client. All changes to the agreed assignment at the request of the client will be additionally invoiced at an hourly rate. Our services can always be refused.

2. Payments
An advance of 50% will be invoiced before the start of the collaboration, unless otherwise agreed. This is non-refundable in case of cancellation. Payments must be made within 15 days of the invoice date, unless otherwise agreed. Invoices are sent digitally by e-mail. If the customer does not pay the invoice on the due date, he will, by operation of law, owe Studio Hōla late payment interest calculated in accordance with the law of 02.08.2002 regarding late payment in commercial transactions, and a fixed compensation of 10% of the invoice amount. with a minimum of EUR 50, from the date of reminder until full payment. In addition, Studio Hōla reserves the right to suspend further performance of its obligations until the client has paid the overdue invoices. Any delay in payment by the client makes all amounts due immediately due and voids any payment method.

​3. Liability and complaints
Studio Hōla undertakes to carry out all services to be provided with care. Studio Hōla is not liable for errors in the implementation due to insufficient or incorrect input by the customer. Due to the digital nature of the services, refunds are not possible.


Studio Hōla cannot be held liable for any consequential damage such as loss of unexpected profit, decrease in turnover, loss of clientele that the client may suffer as a result of any error or negligence on the part of Studio Hōla. 


If no complaint is received within the period of seven days, this means that the client has accepted the services provided in full. 

4. Cancellation
A project only starts after receiving the advance payment. If you wish to cancel after you have paid the advance invoice, this advance is non-refundable. 

Due to my services being digital, I am unfortunately unable to offer a refund. If you are not completely satisfied with the photos, you can request a reshoot for a clear reason. We can avoid this as much as possible thanks to the pre-production process. Aesthetic choices are not a reason for reshoots because this was clearly discussed during pre-production.

5. Disclaimer
Studio Hōla reserves the right to refuse an assignment if new information becomes available after acceptance that makes execution unacceptable for Studio Hōla.

6. Publication by Studio Hōla
Image material created by Studio Hōla can be published at any time on Studio Hōla's website, Facebook, Instagram and all other social media. In addition, Studio Hōla can also use the images for other promotional purposes and publications, including, but not limited to, portfolio, advertisements, social media, magazine articles, competitions, in printing, trade fair material and demonstration material. Unless otherwise agreed. 

7. Publication by the client
Image material created by Studio Hōla may be shared by the customer on the agreed platforms, as laid down in the contract.

 

8. Copyright 
The photos, videos and other works supplied remain the property of Studio Hōla. Upon full payment, the customer purchases the right to print and publish the photos for commercial or personal purposes, as agreed in contract. If the customer uses the photos for commercial purposes without appropriate compensation and agreement for the photographer, legal action will be taken. In the event of infringement of the photographer's copyright, the photographer charges three times the usual license fee for such a case, to compensate for the damage suffered. Compensation does not confer any right to further use of the photographer's work. In addition, these works may not be modified with filters or any other operation.

 

​9. Agree
Anyone who hires Studio Hōla for one or more services automatically agrees to the general terms and conditions.​

 

10.Props
Studio Hōla has a whole collection of props and backgrounds that is always getting bigger and bigger, purchased at the store and which every customer can use at no extra cost, e.g. vinyl backgrounds, stages, miniatures, pearls, glassware, etc. Props such as food, other items that perish over time and specific items needed for your shoot that Studio Hōla does not yet have in its collection will be charged extra to the customer. The full amount of the prop will be invoiced instead of the number of hours it took to find, order and/or adjust this prop to the branding. Knowing that this can often take 2 to 3 hours.
For these reasons, the props purchased for each side's shoot are maintained by Studio Hōla, so they can be reused if necessary.
